Welcome to guillotine.co.uk (the “Website”). The Website is owned and operated by James Taylor, a sole trader trading as Guillotine. In these terms, “we”, “us” and “our” refer to James Taylor trading as Guillotine.
The Guillotine trade mark and brand are owned by 1793 Limited and used by us under licence. Purchases through the Website are made from James Taylor trading as Guillotine.
These terms govern your use of the Website. Please read them before using it. If you do not agree to these terms, you must stop using the Website.
Purchases are governed by our separate Terms of Sale. Our Privacy Notice explains how we handle personal information.
1. Use of the Website
You must use the Website lawfully and must not infringe anyone else’s rights or unreasonably interfere with their use of it.
You must not introduce viruses, malware or other harmful material; attempt to gain unauthorised access to the Website, its servers or connected systems; or use the Website for fraudulent or illegal activities.
2. Intellectual Property
The Guillotine trade mark and brand are owned by 1793 Limited and used by us under licence.
Other intellectual property rights in the Website and its content, including text, photographs, graphics and design, belong to their respective owners. These may include us, 1793 Limited and third-party content providers. Nothing in these terms transfers ownership of those rights to you.
You may view the Website and print or download extracts for your personal, non-commercial use. You must retain any copyright or ownership notices.
Except as permitted by law or with permission from the relevant rights holder, you must not reproduce, distribute, modify or commercially exploit Website content, or use the Guillotine trade mark or branding.
3. Content You Submit
If the Website allows you to submit reviews or other material for publication, you retain ownership of your content. You grant us a non-exclusive, royalty-free licence to reproduce and display it on the Website for the purpose for which you submitted it.
You must have the rights needed to submit that content. It must not be unlawful, defamatory or infringe another person’s rights. Reviews must reflect your genuine experience.
We may remove content that breaches these requirements.
Private enquiries and information submitted through contact or order forms are handled in accordance with our Privacy Notice. This clause does not give us permission to publish private correspondence.
4. Website Information and Availability
We take reasonable care over the Website’s content, but errors may occur and information may become out of date. Please contact us if you identify an error.
We do not guarantee uninterrupted access to the Website. We may temporarily suspend access for maintenance, updates or security reasons.
This section does not limit our obligations concerning product descriptions, purchases or your statutory consumer rights.
5. Our Responsibility for Loss or Damage
If we breach these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it is an obvious consequence or if both you and we knew it might happen.
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Nothing in these terms restricts your statutory consumer rights, including your rights concerning faulty or misdescribed goods.
6. Links to Other Websites
The Website may contain links to third-party websites for your convenience. Unless we expressly state otherwise, a link does not constitute our endorsement.
We do not control third-party websites or their content. Your use of them is subject to their own terms and privacy notices.
7. Suspension of Access
We may restrict or suspend your access where we reasonably believe you have seriously or repeatedly breached these terms, or where necessary to protect the Website, its users or comply with the law.
Where reasonably practicable, we will explain the reason and give you an opportunity to resolve the issue. We may act immediately where necessary for security or legal reasons.
Suspending access does not remove your rights relating to an existing purchase.
8. Changes to These Terms
We may update these terms to reflect changes to the Website, our operations or legal requirements. We will publish the revised terms on this page with an updated date and give reasonable notice of material changes where practicable.
Changes apply to future use of the Website. They do not retrospectively change the terms of an order you have already placed.
9. Governing Law
These terms are governed by the laws of England and Wales.
If you are a consumer, you retain the protection of any mandatory laws that apply in your country of residence. Nothing in these terms limits any right you have to bring proceedings in your local courts.
