Terms of sale

These Terms of Sale apply to consumer purchases made through guillotine.co.uk (the “Website”). Please read them before placing an order.

1. About Us

The Website is operated by James Taylor, a sole trader trading as Guillotine. References to “we”, “us” and “our” mean James Taylor trading as Guillotine. Your purchase contract is with James Taylor.

The Guillotine trade mark and brand are owned by 1793 Limited and used by us under licence.

2. Placing an Order

By placing an order, you make an offer to purchase the selected products. Please check your order and delivery details before submitting it.

Orders are subject to availability and acceptance. A contract is formed when we send you an email expressly confirming acceptance of your order after payment has been processed. An automated acknowledgement of receipt does not itself constitute acceptance.

If we cannot accept your order, we will let you know and promptly refund any payment taken.

3. Prices and Payment

All prices are shown in pounds sterling (£) and include VAT where applicable. Any delivery charges will be shown before you place your order.

We may change prices for future orders, but changes will not affect orders already placed.

Payment must be made in full at checkout using an accepted payment method.

4. Delivery

We aim to dispatch orders within three working days, unless a different timeframe is stated before you order. Working days exclude weekends and public holidays in England and Wales.

Estimated delivery times are shown during checkout. Unless we agree otherwise, we will deliver without undue delay and within 30 days of accepting your order.

If delivery is delayed, please contact us. Your legal rights regarding late or failed delivery remain unaffected. Where the law entitles you to cancel because of a delivery failure, we will refund the payments due to you.

We remain responsible for the goods until they are delivered into your physical possession or that of someone you nominate to receive them, unless you independently appoint a carrier we have not offered.

Please provide accurate delivery details and tell us promptly about any errors.

5. Cancellation, Returns and Refunds

Your right to cancel

For most products, you may cancel your order without giving a reason from the time you place it until 14 days after the day you receive the goods.

If products from a single order are delivered separately, this period ends 14 days after the day you receive the last product.

To cancel, tell us clearly using the contact details on our Contact page. You may use the model cancellation form available with our returns information, but you do not have to.

You must send the goods back within 14 days after notifying us of cancellation. Return instructions and the return address are available on our Returns page. You do not need our approval to exercise your statutory cancellation right.

Condition of returned goods

You may inspect and try on goods as you reasonably would in a shop.

Please return goods with their original packaging and tags where possible. Missing packaging or detached tags do not automatically remove your cancellation right.

We may reduce your refund to reflect any loss in value caused by handling beyond what is necessary to establish the goods’ nature, characteristics and functioning, where the law permits. Wearing goods beyond trying them on, or washing them, may cause such a loss in value.

Return costs and refunds

You are responsible for the direct cost of a change-of-mind return, provided we informed you of this before you ordered. This does not apply to faulty, damaged or incorrectly supplied goods.

If you cancel your entire order, we will refund the product price and the cost of our least expensive standard delivery option. Any additional amount paid for premium delivery is not refundable.

We will refund you without undue delay and no later than 14 days after receiving the returned goods or evidence that you have sent them back, whichever is earlier.

Refunds will be made to the original payment method unless you expressly agree otherwise. We will not charge a refund processing fee.

Exceptions

The change-of-mind cancellation right does not apply to goods made to your specifications or clearly personalised.

It also does not apply to sealed goods genuinely unsuitable for return for health protection or hygiene reasons once unsealed. Ordinary scarves are not automatically excluded merely because their packaging has been opened.

Sale and discounted products have the same statutory cancellation rights as full-price products.

These exceptions do not affect your rights if goods are faulty or not as described.

6. Faulty, Damaged or Incorrect Items

We must supply goods that are of satisfactory quality, fit for purpose and as described.

If an item is faulty, damaged or incorrect, please contact us as soon as reasonably possible so we can resolve the issue. There is no seven-day reporting deadline that limits your statutory rights.

You normally have a short-term right to reject non-conforming goods for a full refund within 30 days of delivery. After that, you may be entitled to repair or replacement and, where the legal conditions are met, a price reduction or refund.

We will cover reasonable return costs for faulty, damaged or incorrectly supplied goods. Please contact us to arrange return or collection.

Where you are entitled to a refund for rejected goods, we will issue it without undue delay and within 14 days of agreeing that you are entitled to it.

7. Product Information

We take reasonable care to describe and display products accurately.

Colours may appear slightly different depending on your screen settings. Where measurements are approximate, we will indicate this.

These statements do not affect our obligation to supply products that match their description.

8. Our Responsibility for Loss or Damage

If we breach this contract or fail to use reasonable care and skill, we are responsible for foreseeable loss or damage you suffer as a result. Loss or damage is foreseeable if it is an obvious consequence or if both you and we knew it might happen when the contract was made.

We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.

Nothing in these terms restricts your statutory consumer rights.

9. Intellectual Property

The Guillotine trade mark and brand are owned by 1793 Limited and used by us under licence.

Other Website content belongs to its respective rights holders. Purchasing a product does not transfer intellectual property rights in the brand, product design or Website content to you.

This does not restrict your lawful use or resale of the product you have purchased.

10. Governing Law

These terms are governed by the laws of England and Wales.

If you are a consumer, you retain the protection of mandatory consumer laws that apply in your country of residence.

You may bring proceedings in the courts of England and Wales or, where applicable, the courts where you live. Nothing in these terms restricts your mandatory rights concerning which courts may hear a dispute.
